TOPBIKE RENTAL & TOURS Terms and Conditions

Responsibilities:

Guests are responsible for: choosing a trip that suits their abilities, fitness level and state of health, providing the TopBike Rental & Tours office with a signed "Release of Liability, Assumption of All Risks and Arbitration Agreement" prior to holiday departure (guests will not be permitted to join a trip without this information on file); arriving at the point of departure with the clothing and gear recommended in the Travel Planner; respecting the laws and customs of Italy; following environmental guidelines and regulations while on the trip in accordance with leader direction; and respecting the rights and privacy of other trip members. An individual may be asked to leave a trip if the leader feels that the person's continuing participation may prove detrimental to the individual or to the well-being and enjoyment of other guests.

Guests are not responsible for any theft of bikes or parts of bikes. This is the sole responsibility of TopBike Rental & Tours.

Guests are not responsible for any breakages or mechanical damage to the bikes which have not been caused by the client's inexperience.

Guests are responsible for any damage to their bikes or to those of other participants caused by their inexperience or negligence.

TopBike Rental & Tours is not liable for bodily injury or property damage as a result of (but not limited to): physical exertion for which a guest is not prepared; forces of nature; travel by plane, train, auto, boat or other conveyance; consumption of alcoholic beverages; civil unrest; terrorism; breakdown of equipment; high altitude; the adequacy of medical attention once provided.

TopBike Rental & Tours is not liable for expenses not specified as included in the trip cost or which may be required to get to or from the start or end of the trip. TopBike Rental & Tours reserves the right to make route and hotel modifications as necessary to improve the trip's quality or to accommodate the comfort and well-being of guests.

Guests grant TopBike Rental & Tours express permission to take photographs or make film records of its trips for promotional and commercial use, as well as approving such use by third parties with whom TopBike Rental & Tours may engage in joint marketing, without financial remuneration.

TopBike Rental & Tours holidays are guaranteed to run anyway (a minimum number of participants is not foreseen), excepting only in cases of force majeure or the failure of third parties - such as the hotel - to honour their reservations in which case all payments received to date will be refunded, which constitutes full settlement. TopBike Rental & Tours is not responsible for expenses that are incurred in preparation for any cancelled reservation, such as airline tickets, or for costs that are incurred due to travel delays, flight cancellations or illness.

Reservations:

Reservations must be made by filling in our online reservation form or through a tour operator or travel agency. The online reservation form allows you to indicate three different starting dates in order of priority.

The acceptance of the reservation is subject to the availability of places.

Within 24 hours of the reservation request, TopBike Rental & Tours will send its acceptance of your booking to the e-mail address indicated on the reservation form (or its refusal of your booking, if there are no places available for all the dates you have indicated), together with instructions for payment of the deposit.

 The reservation is considered to be complete upon payment of the deposit, which must be made within 48 hours of the reservation acceptance.

Room occupancy, Single supplement and Shared room assignments:

TopBike Rental & Tours holiday prices are based on double occupancy.

Single rooms are available for an additional charge, referred to as a "single supplement" in our materials.

If you're travelling alone and wish to share a room, we will attempt to find a roommate for you. If we are unable to do so, you will be charged the customary single supplement.

Payments:

Upon making your reservation, a deposit of € 200 is required for each participant. It may be paid by credit card.

Payment is due in full 60 days prior to the start of the holiday and may be paid by money order in euros. If Payments are not received by the due date, we may cancel the reservation.

Price Guarantee: TopBike Rental & Tours accepts the risk of cost changes of items included in the holiday package. We guarantee our prices through the calendar year.

Cancellation Policies:

If you must cancel your reservation, your cancellation fee will be determined according to the policy outlined below. Exceptions to our cancellation policy cannot be made for any reason, including weather, terrorism, civil unrest or personal emergencies, unless you undersign TopBike Rental & Tours' Holiday Cancellation Insurance. There is no refund for arriving late or leaving a vacation early. Percentage charges are calculated on total trip cost.

*  If cancellation is made more than 60 days prior to the start of the holiday, rather than forfeit the cancellation fees, you may choose to keep your deposit (€ 200) in a holding account to use on a future TopBike Rental & Tours vacation with no expiration date.

Transfers:

You may transfer from one holiday to another up to 60 days before holiday departure without penalty, after which time the 200 euro deposit is due. When transferring to a different date or holiday, if it costs more than your original vacation, you must pay the difference.

Holiday Cancellation Insurance:

It is possible to take out insurance against the risk of your reservation with TopBike Rental & Tours needing to be cancelled. If for any reason it is necessary to cancel a reservation, you will be refunded the entire sum paid after deduction of the deposit (200 euros). The cost of the insurance policy is equal to 5% of the total holiday cost. It is possible to cancel your reservation with TopBike Rental & Tours right up to the last 24 hours before the tour begins, but not once it has started. The holiday cancellation insurance must be undersigned on the reservation form.

Low season:

Low season is from July 16 to August 31 and from November 16 to December 28.

Our association:

TopBike Rental & Tours is run by the "In città usiamo la bici" association of Rome. All our clients receive a free membership card.

Disputes:

For all issues not provided for by the present, the regulations contained in the Legislative Decree 111 of 17/03/1995, implementing the EEC Regulation 314/1990 and the law n. 1084 of 27/12/1977 shall apply.

The Court of Rome will have jurisdiction over any disputes.
